Welcome to Bake Local! These Terms of Service (“Terms”) govern your access to and use of the Bake Local website, mobile application, waitlist forms, and related services (collectively, the “Platform”), operated by Bake Local (“we,” “us,” “our”).

By using the Platform, you agree to these Terms and our Privacy Policy.

1. Overview of Bake Local

Bake Local is a digital marketplace that connects home bakers (“Bakers”) with people who want to order baked goods (“Customers”). Bake Local does not directly prepare, sell, package, or deliver food. All baked goods are created and provided solely by participating Bakers.

2. Eligibility

To access or use the Platform, you must:

Be at least 18 years old
Provide accurate and truthful information
Have the authority to enter into binding agreements
Comply with all applicable laws, including cottage food or licensing requirements

We may suspend or terminate access for violations.

3. Baker Responsibilities

By joining the waitlist, creating a profile, or selling through Bake Local, Bakers agree they are fully responsible for:

A. Legal Compliance

Bakers must comply with all federal, state, and local laws, including:

Cottage food regulations
Required food handling licenses
Permits for selling refrigerated or hazardous foods
Tax reporting and business registration requirements

Bake Local does not inspect or verify compliance.

B. Food Safety and Accuracy

Bakers are solely responsible for:

Safe preparation and handling of food
Truthful statements about ingredients
Disclosure of allergens
Using proper packaging
Fulfillment of orders

C. Communication & Order Handling

Bakers must:

Respond to customers in a timely manner
Provide accurate pickup/delivery information
Honor orders they accept

D. Content Uploaded

Any content (photos, menu items, descriptions) must be lawful, accurate, and not infringe on third-party rights.

4. Bake Local’s Role

Bake Local provides a platform but does not:

Prepare or package food
Verify licenses or food safety
Guarantee quality or accuracy of Baker content
Control how Bakers operate their businesses
Take responsibility for order issues, delays, or food safety concerns

All transactions occur directly between Customers and Bakers.

5. Membership Fees & Payments

Bake Local operates on a monthly subscription model for Bakers.

Membership fees allow Bakers to list their bakery on the Platform.
Bake Local does not charge commission on orders.
Fees may change; advance notice will be provided.
Fees are non-refundable unless required by law.

6. SMS Messaging, Phone Numbers & Consent

When you provide your phone number to Bake Local (via waitlist, account setup, order updates, or forms), you consent to receive SMS messages including:

Waitlist confirmations
Onboarding guidance
Customer order updates
Account alerts
Promotional and marketing messages
Cart reminders (when applicable)

You may opt out of SMS at any time by replying STOP.

Data Handling for SMS

We use phone numbers only for the reasons described above.
We do not sell or share phone numbers or SMS opt-in data with unaffiliated third parties.
Phone number data is stored securely through our service providers (such as Klaviyo).

Bake Local’s website uses cookies to help track items added to carts, including when a cart is abandoned, to send reminder messages.

Provide false, misleading, or harmful information
Use the Platform to conduct illegal activity
Interfere with the Platform’s security or functionality
Abuse SMS or communications features
Upload content that infringes intellectual property rights

We may remove content or terminate accounts for violations.

10. Intellectual Property

The Bake Local name, brand, logos, design assets, and Platform features belong exclusively to Bake Local.

Bakers retain ownership of their own content but grant Bake Local a license to display and promote it within the Platform.

11. Disclaimers

Bake Local provides the Platform “as is” and “as available” without warranties of any kind.

We do not guarantee:

Accuracy of listings
Safety or legality of food products
Performance or uptime
Order fulfillment
Compliance by Bakers
That the Platform will be free of errors

12. Limitation of Liability

To the fullest extent permitted by law, Bake Local is not liable for:

Illness, injury, allergic reactions
Food safety or handling issues
Losses caused by Baker or Customer actions
Delays, cancellations, or incorrect orders
Misrepresentation by Bakers
Lost profits or business interruptions
Data breaches or unauthorized access
Damages from SMS or email communications

Your use of the Platform is at your own risk.

13. Indemnification

Users agree to indemnify and hold Bake Local harmless from any claims arising from:

Their use of the Platform
Violations of food laws
Negligence or misconduct
Inaccurate or unlawful content
SMS misuse
Transactions with other users

14. Account Termination

Bake Local may suspend or terminate accounts at its discretion, including for:

Violations of these Terms
Illegal or unsafe activity
Fraud
Abusive or harmful behavior

Users may cancel their membership anytime; fees already paid remain non-refundable.

15. Governing Law

These Terms are governed by the laws of the State of Florida.
Any disputes shall be resolved through binding arbitration or in courts located in Miami-Dade County, Florida.

16. Modifications to Terms

We may update these Terms at any time.
Changes become effective when posted.
Continued use of the Platform means you accept the updated Terms.
